Terms and Conditions
Service Area: Louisiana
These Terms & Conditions govern all services performed by Bayou Pools (“Bayou Pools,” “we,” or “us”) for the customer (“Customer,” “you”) and apply to pool cleaning, maintenance, leak detection, and related services. By signing a service agreement, accepting an estimate, authorizing work, or allowing access to your property you agree to these terms.
Scope of Services
Bayou Pools provides pool and spa cleaning, routine maintenance, chemical balancing, equipment inspection, leak detection diagnostics, and related services.
Written estimates or service agreements control the price and scope. Any services not expressly included must be separately authorized in writing.
Service Start, Initial Clean, and Frequency
Weekly service agreements commence on the scheduled start date. If a pool requires additional work to meet service standards, an initial startup/bring-up visit will be billed as quoted (standard baseline: $150/hour plus chemicals) unless another rate is provided in writing. Regular service begins the week following completion of the startup visit.
Pricing, Taxes, and Extra Charges
Customer agrees to pay quoted rates for routine service, plus the cost of chemicals, parts, inspection fees, travel, taxes, and any additional charges disclosed in advance.
Extra work (vandalism cleanup, excessive debris, dead animals, drainage issues, major algae remediation, etc.) will be billed at our hourly rate (current default $150/hour) plus materials, with a one-hour minimum unless otherwise agreed.
Filter cleanings, salt cell cleanings, or other periodic maintenance not included in weekly service will be billed per the schedule in the estimate/contract.
Payments, Billing, and Collections
Invoices are delivered electronically at the start of the month or upon completion of services as stated in the agreement. Payment is due immediately unless alternative payment terms have been agreed in writing.
Late fee: $25 for invoices not paid by the 1st of the following month (or as specified). Accounts unpaid 45 days after invoice date may be suspended. Returned check or card chargeback fees will be billed to the Customer.
Payments accepted: online payment link, credit/debit card, ACH/bank transfer, check, or money order to our business address. Customer is responsible for ensuring timely payment.
Cancellation, Suspension, and Termination
Ongoing service may be canceled by Customer via written/email notice. Final billing will include charges through the notice effective date and any outstanding balances.
Bayou Pools may suspend or terminate services for nonpayment, unsafe conditions, repeated access issues, or breach of these terms. Restarting service after termination or extended suspension may require a one-time bring-up fee.
Access, Keys, and Lockouts
Customer must provide safe, unobstructed access to the pool area and equipment (key, gate code, unlocked gate). No refunds for missed or incomplete visits due to lockouts.
Bayou Pools is not responsible for loss, theft, or damage to keys left with technicians; keys will be returned to the designated location or customer upon request.
Customer Responsibilities & Site Conditions
Maintain safe access, contain pets, remove pool covers, and ensure a functioning 120V power source and a garden hose with adequate reach and pressure are available unless otherwise agreed.
Keep pets, children, and bystanders away from the work area. Customer is responsible for injuries caused by their pets or visitors.
Maintain pool water level and reasonable clarity. Bayou Pools is not responsible for equipment damage caused by low water levels, excessive debris, or unsafe water conditions.
Equipment Repairs, Minor Work Authorization
Bayou Pools may perform repairs or replace parts costing under $200 (or an agreed threshold) without prior authorization to prevent further damage; Customer will be notified. Repairs over that threshold require prior approval. Bayou Pools is not liable for damage resulting from Customer’s refusal to authorize necessary repairs.
Salt Systems
Salt is corrosive; Bayou Pools is not responsible for corrosion, staining, or deterioration due to salt use unless damage is caused by Bayou Pools’ negligence. Salt cell cleaning is available at the rate quoted in the agreement.
Safety and Chemical Handling
Bayou Pools will handle chemicals in accordance with label instructions and applicable regulations. Customer agrees to follow posted safety recommendations and to inform Bayou Pools of any known hazards (e.g., buried utilities, hidden access panels).
Customers should notify Bayou Pools of any chemical sensitivity, medical devices (such as hearing aids), or other conditions that may be affected by service activities.
Leak Detection Terms & Conditions
Leak Detection Services — Scope & Limitations
Leak detection services are diagnostic and non-invasive only unless otherwise specified. They include visual inspection and any tests expressly listed in the written estimate (electronic scanning, pressure testing, dye testing, acoustic detection, camera inspection, vacuum testing, SCUBA inspections where appropriate).
Not all tests will be performed on every job. Additional tests, destructive access, excavation, specialized repairs, or replacement parts require separate written authorization and pricing.
Leak detection findings reflect conditions at the time of inspection and are not guarantees. Acoustic and other detection methods can be affected by soil, utility noise, groundwater, and other factors; reported locations may be approximate.
Client-Site Preparation for Leak Detection
Customer must remove pool covers, ensure clear water visibility, provide power and hose access, and make equipment accessible before arrival. Bayou Pools may charge hourly rates for cover removal or additional staging if not done prior.
Bayou Pools may decline to proceed for unsafe or inaccessible conditions.
Vinyl Liners, Concealed Conditions, and Component Handling
Removing water behind vinyl liners, pressure testing, or other diagnostic measures can stress liners or brittle components; Bayou Pools is not responsible for damage to liners, hidden piping, or components.
Bayou Pools is not responsible for concealed defects behind finished surfaces, underground piping, or damage requiring demolition/excavation unless included in a written scope.
In-floor cleaning systems, floor returns, pop-up cleaners, decorative water features, and other specialty systems may require additional fees and carry risk of damage during testing; Bayou Pools is not responsible for preexisting or test-related failure of brittle, aged, or plastic components.
Revisit Policy
If Customer disputes diagnostics, submit written notice within 14 calendar days describing the concern and any changes. Bayou Pools may, at its discretion, perform a revisit. Revisit requests after 14 days may be treated as new service calls and billed accordingly.
Warranties and Limitations of Liability
Bayou Pools provides no express or implied warranties beyond those stated in a written agreement. Work performed by Bayou Pools is warranted only if a written warranty is provided.
To the maximum extent permitted by law, Bayou Pools’ liability for claims arising from services is limited to direct damages up to the total amount paid by Customer for the specific service in the prior 12 months. Bayou Pools is not liable for consequential, incidental, punitive, or special damages, lost profits, or third-party claims.
Nothing herein limits liability for gross negligence or willful misconduct to the extent prohibited by law.
Indemnity
Customer agrees to indemnify, defend, and hold harmless Bayou Pools and its employees, agents, and subcontractors from claims arising out of Customer’s breach, negligence, improper site conditions, or acts of third parties.
Privacy, Photos, and Access to Records
Bayou Pools may take photos or video of the pool and equipment for documentation, diagnostics, or marketing unless Customer objects in writing before service. Customer data and contact information will be used to provide services, billing, and communications in accordance with our privacy practices.
Service reports and records are available to the Customer. Bayou Pools may retain copies for business records.
Subcontractors and Assignment
Bayou Pools may subcontract work to qualified third parties. Bayou Pools remains responsible for the actions of its subcontractors for work it directly contracts to perform.
Customer may not assign the agreement without Bayou Pools’ written consent.
Force Majeure
Bayou Pools is not liable for delays or failure to perform due to causes beyond its reasonable control, including acts of God, storms, floods, hail, lightning, fire, war, strikes, government actions, epidemics, or severe weather.
Dispute Resolution and Governing Law
These terms are governed by the laws of the State of Louisiana. Parties agree to negotiate in good faith to resolve disputes. If unresolved, disputes will be submitted to binding arbitration in Louisiana under the rules of the American Arbitration Association (or other mutually agreed forum) for claims under $50,000; parties may pursue injunctive or emergency relief in court as needed.
Venue for any court action is Ouachita Parish or the appropriate parish where services were performed.
Notices
Notices required under these terms shall be sent to the contact information provided in the service agreement or to Bayou Pools at 901 Old Sterlington Rd., Sterlington, LA 71280 or the email address listed on our website. Electronic notices and invoices are effective when delivered.
Modification of Terms
Bayou Pools may amend these terms from time to time; revised terms apply to new services or as otherwise provided. Continued acceptance of service after notice constitutes acceptance of updated terms.
Entire Agreement
These Terms and Conditions, together with the written service agreement, estimates, and authorized change orders, constitute the entire agreement between the parties and supersede prior oral or written agreements.
